Terms of Use
- Effective date:
This page is an English translation of the Japanese original. The Japanese version is the official text. If the interpretation of this English version differs from that of the Japanese version, the Japanese version and Japanese law prevail.
These Terms of Use (the "Terms") set out the conditions for using the website "Hikariza" (https://hikariza.com/; the "Service") provided by the Hikariza Operator (Kohei Katada; the "Operator"). By using the Service, you are deemed to have agreed to these Terms.
Article 1. What the Service Is
The Service lets you make a 3D avatar dance to music on a glowing stage inside your browser and export the performance as a video (such as an MV). Users can also load and use VRM files (3D avatar data) they have prepared themselves.
Article 2. Fees and How the Service Is Provided
- The Service is free to use.
- The Service is provided as is. The Operator does not guarantee that the Service will suit users' purposes, be accurate, work on every device and browser, or be available without interruption.
- The Operator may change the content of the Service, or temporarily suspend or end its provision, without notice.
Article 3. VRM Files and Other Materials Users Load
- VRM files and other materials loaded into the Service are limited to those the user has the right to use.
- When using a VRM, follow the terms of use set by the model's creator (including the license information contained in the VRM file and the terms of the distribution source, such as VRoid Hub or BOOTH).
- If a problem arises with a third party concerning materials a user has loaded, the user shall resolve it on their own responsibility.
Article 4. Rights to the Service's Materials
- The rights to the Service's programs, design, logos, music, motions (choreography, including purchased motion assets), stages, and other materials belong to the Operator or to their respective rights holders.
- Extracting these materials themselves from the Service, redistributing them, reselling them, or reusing them in other services or apps is prohibited. The same applies to extracting only the music or motions from an exported video for use.
- Fonts and other items whose use is separately permitted under their own licenses are governed by those licenses.
Article 5. Handling Exported Videos
- When you post an exported video to your personal social media or elsewhere, do so on your own responsibility.
- Handle videos showing a VRM avatar in accordance with the terms of use set by that avatar's creator (provisions on use in videos, commercial use, credit notation, and so on). If the creator asks for credit, include it with your post.
Article 6. Rules on Characters and Expression
- Characters used in the Service (including VRMs you load) are limited to those that appear to be adults (18 or older).
-
The following expressions are prohibited:
- Depictions of sexual acts
- Nudity, or depictions in which genitals or nipples are visible
- Depictions that treat a character who appears to be a child (under 18) sexually
Article 7. Prohibited Conduct
When using the Service, users must not do any of the following:
- Anything that violates laws and regulations or public order and morals
- Infringing the copyrights, portrait rights, trademark rights, or other rights of the Operator or third parties
- Attacking the Service's servers or network, placing an excessive load on them, or gaining or attempting to gain unauthorized access
- Interfering with the operation of the Service
- Defaming others or damaging their reputation or credibility
- Violating Article 4 or Article 6
- Anything else the Operator deems inappropriate
Article 8. YouTube API Services
The Service uses YouTube API Services (to publish and manage MVs on the Operator's own YouTube channel). For the parts related to YouTube API Services, users are deemed to have agreed to be bound by the YouTube Terms of Service. For how information is handled, please see the Privacy Policy.
Article 9. Disclaimer
- The Operator is not liable for any damage users suffer from using the Service (including device malfunctions, loss of data, and failures in exporting or saving videos), except where caused by the Operator's willful misconduct or gross negligence.
- Settings saved on your device may be lost, for example when browser data is cleared. Please save important things, such as exported videos, yourself.
- Disputes between users and third parties concerning the Service shall be resolved on the user's own responsibility.
Article 10. Changes to These Terms
The Operator may change these Terms as necessary. The changed Terms take effect when they are posted on this page together with the revision date. If you use the Service after a change, you are deemed to have agreed to the changed Terms.
Article 11. Governing Law and Jurisdiction
These Terms are interpreted in accordance with the laws of Japan. If a dispute arises concerning the Service, the district court having jurisdiction over the Operator's address shall be the exclusive agreed court of first instance.
